Legal Process Outsourcing (LPO): Law Firm Friend or Foe?

We read with interest a recently published Hildebrandt interview of Georgetown Law Professor Milton C. Regan, Jr on Outsourcing and the Impact on Legal Work . Professor Regan has thought long and hard about the future of law firms.  He co-organized the recent Georgetown Law conference on the future of law firms, summarized in our recent post Law Firm Evolution or Revolution .   At the conference, he presented ideas from a forthcoming journal article (details and link at end). The interview, like his presentation and paper, is thought-provoking.  We agree with much of it but take exception to a crucial point.   We disagree with his view that legal process outsourcers (LPO) can substitute for law firms, especially his view that LPOs can advise clients.  We start with this disputed point and then comment on several on which we do agree. Advice. Regan observes that once clients break down work into components, they “can find lower cost providers, either domestically or abroad, lawyers or non-lawyers, [and this] could hollow out a good portion of a firm’s operations… Right now, the standard distinction is that LPOs do routine work and law firms provide strategic advice.”  As LPOs understand their clients better, he suggests they will be “in a better position to provide advice.” As an LPO, we neither can nor should provide advice.  We cannot provide advice because we are not licensed to practice law; our providing advice would violate the unauthorized practice of law rules.  Moreover, we should not provide advice as a strategic business imperative.  Specifically, we work with law firms (and law departments).  So it is not in our interest to compete with firms.  Instead, we seek to free-up outside counsel to provide more and better advice. Rather than represent a competitive threat, LPOs allow firms to offer clients better value by outsourcing repetitive and routine work.  LPOs, with their expertise and investment in process engineering, quality control systems, and technology are well-positioned to perform these tasks.  But we are limited to tasks that lawyers can, practically and ethically speaking, delegate and supervise. Project Management. Relating to the topic of high-volume work, Hildebrandt asks Prof. Regan about project management.  He suggests PM is increasingly important for law firms.  We agree that firms need people “who can analyze the different steps involved in providing a service” and “to do cost accounting in a reasonably precise sort of way.”  Hiring the right personnel to decompose  work into steps and analyze profitability accurately will allow firms to identify routine, high volume tasks

Should You Outsource Your Medical Billing?

One of the many business questions physicians face is whether to outsource their medical billing to third-party medical billing services or do it in-house with medical billing software. Some physicians would assume outsourcing billing to a medical billing service makes the most sense. After all, they’re the experts with the resources to properly process your claims, right? Others might want to maintain control of collections and do it all in-house. Hold on. Don’t make a decision before thinking it through. Both methods of revenue cycle management have benefits and drawbacks

Entrepreneurs Need to Make Time For Family

I know some entrepreneurs with successful businesses, and others who seem to have a great relationship with their family, but I can’t think of many who have both. Some people would argue that these two successes are mutually exclusive, but I’m not convinced. Individually, they both take focus, commitment, and a variety of skills, all the strengths of a good entrepreneur. Assuming a person wants both a family and a business, the challenge is to achieve a balance that can satisfy both. From my observational experience, as well as my personal struggles on both sides of this equation, here are some of the key parameters of that balance: Start with a solid relational and business foundation. A successful business won’t lead to a great family relationship, and vice versa

First Quarter 2010 Part 4 of 4: Strategic Outsourcing Partnerships Abound in March

What have certainly abounded this first quarter are the strategic partnerships that have been formed among different types of companies across the industry. Efforts to diversify their product offerings are at the root of this trend as competition for outsourcing contracts increases. Just for this quarter alone, there has been a surge in strategic partnerships being formed especially among smaller outsourcing companies. For the IT outsourcing industry, spend management, sourcing and procurement services provider Perfect Commerce announced a partnership with fellow IT and procurement outsourcing provider Corbus LLC. First Quarter 2010 Part 3 of 4: Notable Contracts Are Won

For the first quarter of 2010, there were some notable outsourcing contracts established, albeit they’re not the ‘mega deals’ of old, but substantial they are still. It was data and advisory firm TPI , who projected on the 18th of March that the global outsourcing contract volume is set to increase this 2010.  The Economic Times even projects that $1 billion worth of outsourcing contracts are headed for India this year.  These contracts, as Everest Group’s Gaurav Gupta stated are typically in the range of $50-100 million.  He further adds that Indian IT services vendors currently have some mega outsourcing contracts in the pipeline. One such contract is Punjab & Sind bank’s contract with Indian IT Company Wipro (NYSE:WIT) on the 24th of February, wherein the two companies signed a 10-year comprehensive IT outsourcing contract.  A deal that had previously been awarded to Satyam (NYSE:SAY) .  The contract featured prominently in the news due to the failure of the previous contract with Satyam. But what we estimate as one of, if not the largest contract for the quarter is the $200 million IT outsourcing contract of Accenture (NYSE:ACN) with Starwood Hotels and Resorts for the development, maintenance and running of the applications of the hotel.  The deal was signed on the 15th of March.  The deal sits high on the list of substantial deals for this quarter as Starwood Hotels (NYSE:HOT) is one of the biggest hotel and leisure companies in the world, including, Westin, Le Meridian and Sheraton. There are other equally notable deals that have gone through this quarter, including contract extensions such as CSC’s (NYSE:CSC) contract extension with United Technologies Corporation which is projected to add over $1.5 billion in value to the existing contract in a five-year period that was announced on the 18th of March; and Lockheed Martin’s (NYSE:LMT) contract extension with NASA, which has an estimated value of approximately $230 million. The contracts are just beginning to pour in.  This March, the amount of contracts being won has been steadily increasing with the economy’s recovery.  It is expected that the pace and value of the contracts will increase further by year’s end and perhaps we will see the ‘mega deals’ return once again. Friction is Feedback, Don’t Forget to Listen

Entrepreneurship is not a job for the Lone Ranger. Every startup requires building and maintaining effective relationships with people, including partners, team members, customers, and investors. That means giving and asking for feedback, and learning from it, especially negative feedback. “Friction” is feedback mixed with emotion, making it all the more difficult to sort out the value. There should be no immediate assumption that one side is right, and the other is wrong. It may be an indication that one party isn’t giving the feedback well, or the other isn’t taking it well, or both. Both of these modes are wrong, and non-productive. Unfortunately, many entrepreneurs I talk to confess that they put off giving feedback because they are uncomfortable

How to be a Social Entrepreneur vs Business

A term I’m hearing more and more these days is “social entrepreneur.” In the simplest of terms, these are people who seek to generate “social value”, rather than profits, and use traditional business principles to create and manage a venture to make social change. On the surface, this sounds like entrepreneurs who want to build a non-profit organization. Yet the term seems to be more often associated with people whose work is targeted toward long-term socio-economic change. Think Margaret Sanger (birth control) or Mahatma Gandhi (non-violent), as opposed to the leaders of the Cancer Society or Goodwill Industries. Whether the objective is to generate profits or social capital, the common element for all entrepreneurs is the recognition that there is a problem which needs solving, or there is an opportunity to improve the status quo. The vision is always to be a change agent, to invent and popularize new approaches, and to persuade people to take a leap forward.

First Quarter 2010 Part 2 of 4: Prospects in Outsourcing

Prospects for outsourcing in the current year seem very bright indeed; this is according to different surveys and market estimates indicated during this first quarter. On the 6th of January, PriceWaterhouseCoopers released a survey which found that the outsourcing industry is changing due to the emergence of new service providers from all over the world and not just the US or India. As indicated in a previous article , companies have been steadily expanding their businesses by establishing facilities in new locations all over the world such as Africa and Egypt, which shows that outsourcing companies are expecting bigger business ahead and are diversifying their product offering. IT research and advisory company, Gartner (NYSE:IT), indicated in a survey on the 15th of March that 85% of organizations are anticipating spend on external service providers to increase or stay the same as the economy recovers. The company estimates that Indian BPO market will grow by 19% through 2013, becoming a $1.8 billion market. Previous hesitation on the part of corporations in investing on IT spending will be largely assuaged in the coming months as the recovery continues

Article Content : More doctors nationwide are choosing to contract out or outsource their medical billing needs. This means that professionals training today have even more options to build a solid medical billing career! As a medical billing professional, you will typically provide services to specialty physician groups and primary care practices and process Medicare, Medicaid and private health insurance claims – and working with a third-party billing company is no different. The Department of Health and Human Services defines third party billing companies as “providing a valuable service to providers and suppliers who seek out their help in submitting claims correctly and efficiently. These firms vary greatly, performing a wide variety of services from simply formatting claims for submission to Medicare and private insurance companies to managing the entire ‘business end’ of provider practices.” In addition to seeing that health care providers get paid for their services, billing professionals who work in a third-party billing setting usually offer a wide range of functions. In fact, in this career, you will perform many of the same extensive duties as an in-house medical biller: – Manage patient data – demographic and incurred charges – Prepare insurance claims- Follow up on unpaid claims- Post payments- Bill patients for deductibles and co-insurance – And moreThird party billing companies have a long and storied history, but larger-sized billing companies did not become more commonplace until the 1980s when it was required that hospital-based physicians’ services be billed separately. Today, according to statistics by the Healthcare Billing and Management Association (HBMA) third party medical billing companies employ nearly 20,000 people nationwide and process more than 17 million claims per month. Partnering with a third-party billing company can help health care providers increase cash flow and productivity, as well as enable them to concentrate on health care services, not on collecting bills

Medical Coding Information:The Right Medical Billing Software Can Make All of the Difference

Article Summary : 21coding.com Medical Coding Blog is dedicated to students and working professionals in the medical coding and billing profession, whether as an employee in a medical office, or health insurance organization, or an independent consultant working from home. Article Content : When it comes to the practice of medical billing, precision is absolutely paramount to ensuring that payment from claims submitted to insurance companies, or respective administration entities, is received by the doctor or other licensed health care provider who provided the service. Most medical billing professionals are required to perform a myriad of duties that include managing healthcare billing as well as processing, altering and resubmitting claims while adhering to the most current regulations and policies in the industry. Even the most experienced and well-trained in the field are prone to the possibility of human error, which can end up being extremely costly to the healthcare provider. This is why the use of electronic medical billing has been rapidly gaining in popularity throughout the medical field.By incorporating the use of software, those who work in medical billing can increase their precision in tracking a range of functions – from keeping tabs on patient demographics, appointments and diagnoses, to gathering and keeping track of billing information and insurance payments, scheduling, and generating reports. In addition to significantly reducing the chance for human error, the use of an electronic medical billing system generally offers substantial savings in time and money, as it makes sure that every patient bill is paid and all accounts received are kept up to date. The majority of electronic billing systems for the medical industry require that the user sticks with the sections detailed in the Health Insurance Portability and Accountability Act (HIPAA), which emphasize improved security standards, ANSI billing formats, etc
